經常在美劇中聽（tīng）到一（yī）級謀殺、二級謀殺（shā）、重罪（zuì）謀殺這些概念，不同的謀（móu）殺是如何定性的。一（yī）起來感（gǎn）受一下吧。
Common Law Murder
普通法下的謀殺
Common law murder is the unlawful killing of a human being with malice aforethought. Malice aforethought was committed with one of the following states of mind:
▪ intent to kill
▪ Intent to inflict great bodily injury
▪ reckless indifference to an unjustifiably high risk to human life; or
▪ intent to commit a felony
普通法下的謀殺是有預謀（móu）的非法殺害一個人。預謀在主觀上表現為故意殺害；故意使（shǐ）之遭受嚴重的身體（tǐ）傷害；魯（lǔ）莽的忽視對（duì）於一個人生命的不合理的高（gāo）風險；或者（zhě）故意犯下重罪。

In some jurisdictions, murder is divided into degrees by statute.
在一些司法管（guǎn）轄區，依據法（fǎ）規，謀殺被劃分為（wéi）不同的等級。
First Degree Murder
一（yī）級謀殺
First degree murder requires that the defendant made the decision to kill in a cool and dispassionate manner and actually reflected on the idea of killing. It requires a specific intent, meaning that the defendant must have acted with intent or knowledge that their conduct would cause death.
一級謀殺是指被告（gào）以一種非常（cháng）冷靜的方（fāng）式，切實的仔細思考（kǎo）殺人後，作出的殺人決（jué）定。一級謀殺要求特定犯意，即被告（gào）的（de）行為必須是故意（yì）的或者是知道他們的行為會導致死亡的後（hòu）果。
Second Degree Murder
二級謀殺
Second degree murder is similar to common law murder. It can be any murder that is not classified as a first degree murder.
二級（jí）謀殺類似於普通（tōng）法下的謀殺，它可以是除一級謀殺外的任（rèn）何謀殺。
Felony Murder
重罪（zuì）謀殺
Any death caused in the commission of, or in an attempt to commit, a felony is murder. The felonies most commonly listed are burglary, arson, rape, robbery, and kidnapping.
任何因實施或試圖（tú）實施重罪而導致的死亡構（gòu）成重（chóng）罪謀殺。通常所（suǒ）列重罪有夜盜、縱火、強奸、搶劫和綁架（jià）。
Voluntary Manslaughter
激情殺人
Voluntary manslaughter occurs when there is existence of adequate provocation. The provocation is adequate if it arouses sudden and intense passion in the mind of an ordinary person, causing them to lose self-control and leaving them no time to cool off.
當存在充分（fèn）的挑釁時，就會發生激情殺人。充分的挑釁是指挑釁可（kě）以對一個普通人產生突然的強烈的激情，導致他們失去自我控製並使他們沒有時間冷靜下來。
Involuntary Manslaughter
非激情殺人
A killing is involuntary manslaughter if it was committed with criminal negligence during the commission of an unlawful act.
非激情殺人是指（zhǐ）在實（shí）施一項不法行為的過程中，因犯罪（zuì）性的過失而實施的（de）殺人行為。
我國《刑法》
第二百三十二條 故意殺人的，處死刑、無（wú）期徒刑或者十年以上有期徒刑;情節較輕的，處三年以上（shàng）十年以下有（yǒu）期徒刑。
第二百三十三條 過失致人死亡的，處三年以上七年以下有期徒（tú）刑;情節較輕的，處三年以下有期徒刑。本法另有規（guī）定的，依照規定。
第二百三十四條 故意傷害他人身體的，處三年（nián）以下有期（qī）徒刑、拘役或（huò）者管製（zhì）。
犯（fàn）前款罪，致人重傷的（de），處三年（nián）以上十年以下有期徒刑;致人死（sǐ）亡或者以特別（bié）殘忍（rěn）手（shǒu）段致人（rén）重傷造成嚴重殘疾的，處十年以上有期徒刑、無期徒刑或者死刑。本法另有規定的，依照規定。
